Welcome to Joyfans ("Joyfans", "we", "us", or "our"). These Terms of Use ("Terms") form a legally binding agreement between you and Joyfans and govern your access to and use of our website, applications, and services (collectively, the "Service"). By creating an account, confirming you are 18 or older, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Age Requirements
The Service is intended exclusively for adults aged 18 years or older (or the age of majority in your jurisdiction, if higher). The Service contains mature, adult-oriented content. By using the Service you represent and warrant that you are at least 18 years old and legally permitted to access such content where you live. We may require confirmation of your age and may suspend or terminate accounts where we have reason to believe a user is underage.
2. Acceptable Use
You agree to use the Service only for lawful, personal, non-commercial purposes and in a manner consistent with these Terms and all applicable laws. You are responsible for all activity that occurs through your account. You agree not to misuse the Service, interfere with its operation, or attempt to access it using a method other than the interface and instructions we provide.
3. Account Registration and User Responsibilities
To access most features you must create an account using a valid email address and password, or a supported third-party sign-in. You agree to provide accurate information and to keep your credentials confidential. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately of any unauthorized use. We are not liable for losses arising from your failure to protect your account.
4. Virtual Currency (Diamonds), Gifts, and Purchases
The Service uses a virtual currency called Diamonds. Diamonds may be obtained through the Service (for example, daily check-in rewards) and, where offered, through purchase. Diamonds are spent on features such as sending messages, voice playback, and virtual gifts to your companion.
- Diamonds and virtual gifts have no monetary value, are not real currency, and cannot be exchanged for cash, transferred between accounts, or redeemed outside the Service.
- Diamonds are licensed to you for use within the Service, not sold. We may adjust pricing, balances, earn rates, and feature costs at any time.
- Virtual gifts and the relationship effects they produce are purely cosmetic and entertainment features within the Service.
- Any Diamonds remaining when an account is closed or terminated are forfeited.
5. Refund Policy
Except where required by applicable law, all purchases of Diamonds and other virtual items are final and non-refundable. Virtual currency that has been granted, purchased, or spent is not refundable or exchangeable. If you believe you were charged in error, contact us at [email protected] and we will review your request. Nothing in this section limits any statutory rights you may have that cannot be waived.
6. AI-Generated Content Disclaimer
The characters, personalities, messages, voices, and images on the Service are artificial intelligence and are entirely fictional. They are not real people, and conversations are generated automatically by AI models. AI output may be inaccurate, inconsistent, offensive, or otherwise unsuitable, and does not represent the views of Joyfans.
AI responses are for entertainment only and must not be relied upon as professional advice. Nothing on the Service constitutes legal, medical, psychological, financial, or other professional advice. Do not make decisions based on AI output. If you need professional help, consult a qualified professional. If you are in crisis or danger, contact your local emergency services.
Any emotional attachment you form with an AI companion is your personal choice and responsibility. The Service is designed for entertainment and companionship and is not a substitute for human relationships, therapy, or professional care.
7. User-Generated Content
You are solely responsible for the content you submit, including the messages you send to companions ("User Content"). You retain ownership of your User Content but grant Joyfans a non-exclusive, worldwide, royalty-free license to host, store, process, and use it as necessary to operate, secure, and improve the Service, including transmitting it to the AI providers that generate responses. You represent that you have the right to submit your User Content and that it does not violate these Terms or any law.
8. Prohibited Activities
You agree that you will not, and will not attempt to:
- Create, request, or distribute any content involving minors or anyone appearing to be under 18, including any sexualized depiction of minors.
- Generate or solicit content depicting non-consensual acts, coercion, incest, bestiality, or content sexualizing real, identifiable people without consent.
- Use the Service for any illegal purpose, or to harass, threaten, defame, or harm others.
- Impersonate any person or misrepresent your affiliation with anyone.
- Reverse engineer, scrape, decompile, or attempt to extract the source code, models, or prompts of the Service, except where permitted by law.
- Use bots, automation, or exploits to access the Service, manipulate Diamonds, or circumvent limits or security.
- Resell, sublicense, or commercially exploit the Service or any content without our written permission.
- Interfere with, overload, or disrupt the Service or its infrastructure.
Violations may result in immediate suspension or termination and, where appropriate, referral to law enforcement.
9. Intellectual Property Rights
The Service, including its characters, names, software, text, designs, graphics, and other content (excluding your User Content), is owned by Joyfans or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. All rights not expressly granted are reserved.
10. Service Availability and Limitations
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at any particular time. Features, companions, and content may change, be limited, or be discontinued at any time without notice. AI generation depends on third-party providers whose availability we do not control.
11. Account Suspension or Termination
We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure, or for any other reason at our discretion. You may stop using the Service and request account deletion at any time. Upon termination, your right to use the Service ceases and any remaining Diamonds are forfeited.
12. Disclaimer of Warranties
To the maximum extent permitted by law, Joyfans disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranties regarding accuracy, reliability, or the conduct or output of AI companions.
13. Limitation of Liability
To the maximum extent permitted by law, Joyfans and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or emotional distress, arising out of or related to your use of (or inability to use) the Service, AI-generated content, or any reliance on it. Our total aggregate liability for any claim shall not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.
14. Indemnification
You agree to indemnify and hold harmless Joyfans and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law.
15. Changes to the Service and These Terms
We may modify the Service or these Terms at any time. When we make material changes, we will update the Effective Date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
16. Governing Law and Contact
